Terms & Conditions

1. Introduction

Welcome to Funnelpool. These Terms of Service ("Terms") govern your access to and use of the FunnelPool platform, website, applications, features, and related services (collectively, the "Services"). By creating an account, accessing, or using FunnelPool, you agree to comply with these Terms. If you do not agree with any part of these Terms, you should discontinue use of the Services immediately.

2. Eligibility

To use FunnelPool, you must be at least 18 years old and legally capable of entering into a binding agreement. By using our Services, you represent and warrant that you meet these requirements and that all information provided during registration is accurate and complete.

3. Your FunnelPool Account

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to:

  • Keep your account information accurate and up to date.

  • Maintain the security of your password.

  • Notify FunnelPool immediately of any unauthorized access or suspected security breach.

  • Use only one account unless otherwise authorized.

FunnelPool is not responsible for losses resulting from unauthorized access caused by your failure to secure your account.

4. Using FunnelPool

FunnelPool provides business automation tools designed to help organizations capture leads, automate customer journeys, manage communications, schedule appointments, build funnels, create marketing campaigns, and streamline business operations.

5. Acceptable Use

You agree that you will not use FunnelPool to:

  • Send spam or unsolicited communications.

  • Promote illegal products or services.

  • Distribute malware, viruses, or harmful software.

  • Attempt unauthorized access to any system or account.

  • Upload or distribute copyrighted material without permission.

  • Harass, threaten, or abuse other users.

  • Violate any applicable laws or regulations.

  • Misrepresent your identity or business.

Violation of these rules may result in suspension or permanent termination of your account without prior notice.

6. Subscription, Billing & Payments

FunnelPool is offered through recurring subscription plans.
By purchasing a subscription, you agree that:

  • Subscription fees are billed in advance.

  • Payments renew automatically unless cancelled before the next billing cycle.

  • You are responsible for any applicable taxes.

  • Failure to complete payment may result in suspension or termination of access.

Pricing may change in the future. Existing subscribers will be notified before any pricing changes take effect.

7. Free Trials & Demonstrations

FunnelPool may, at its sole discretion, offer personalized demonstrations, limited trial access, or promotional offers to selected customers. Trial availability, duration, and eligibility are determined by FunnelPool and may vary depending on individual business requirements. Trial access does not guarantee future availability or continued promotional pricing.

8. Intellectual Property

All content, software, technology, branding, logos, graphics, workflows, templates, documentation, AI capabilities, automation systems, and other materials available through FunnelPool remain the exclusive property of FunnelPool or its licensors. Nothing contained within the Services grants ownership of any intellectual property rights. You may not copy, modify, distribute, reverse engineer, reproduce, sublicense, or commercially exploit any part of the Services without prior written permission from FunnelPool.

9. Third-Party Services & Technology

To provide and continuously improve the Services, FunnelPool works with carefully selected third-party service providers, infrastructure partners, payment processors, communication platforms, and other technology providers.

Certain features of the Services may rely on licensed third-party technologies that are integrated into the FunnelPool platform. These providers process information only as necessary to deliver the Services and are contractually or legally required to protect your information.

The availability, performance, and functionality of third-party services may be subject to their own terms, policies, and operational requirements. FunnelPool is not responsible for interruptions, delays, or limitations caused solely by third-party providers beyond our reasonable control.

10. Data & Customer Information

You retain ownership of the information, contacts, and business data you upload to FunnelPool. By using our Services, you grant FunnelPool permission to process your data solely for the purpose of providing and improving the Services. FunnelPool does not claim ownership of your business information.

11. Service Availability

FunnelPool continually works to provide a reliable platform; however, uninterrupted or error-free service cannot be guaranteed. Scheduled maintenance, software updates, infrastructure improvements, or circumstances beyond our reasonable control may temporarily affect service availability. We reserve the right to modify, improve, suspend, or discontinue any feature when necessary.

12. Account Suspension & Termination

FunnelPool reserves the right to suspend, restrict, or terminate your access to the Services, with or without prior notice, if we reasonably believe you have:

  • Violated these Terms of Service.

  • Failed to pay applicable subscription fees.

  • Used the Services for unlawful, fraudulent, or abusive purposes.

  • Compromised the security, integrity, or performance of the platform.

  • Engaged in activities that may negatively affect other users or FunnelPool.

You may discontinue using FunnelPool and cancel your subscription at any time. Termination does not relieve you of any outstanding payment obligations incurred before cancellation.

13. Workspace Transfers & Administrative Fees

FunnelPool understands that businesses may occasionally need to transfer ownership of their workspace to another organization, agency, or authorized account. To ensure a secure and accurate transition, workspace transfers are handled by our support team and are subject to an administrative review process. A one-time administrative transfer fee of USD $500 applies to all approved workspace transfers. This fee covers account verification, migration support, ownership validation, configuration review, and administrative processing required to complete the transfer.

A workspace transfer will only be initiated once all of the following requirements have been satisfied:

  • All outstanding subscription fees and invoices have been paid in full.

  • The administrative transfer fee has been received.

  • The receiving party has confirmed acceptance of the transfer.

  • Ownership has been successfully verified by FunnelPool.

  • Any required documentation has been submitted.

Once the transfer has been completed, the previous account owner will relinquish administrative control of the workspace unless otherwise agreed in writing. FunnelPool reserves the right to decline or delay any transfer request if it determines that the request is incomplete, unauthorized, or may compromise the security or integrity of the platform.

14. Refund Policy

Subscription fees are generally non-refundable unless otherwise required by applicable law or explicitly agreed to in writing by FunnelPool. If you believe you have been charged incorrectly, please contact our support team promptly so we can review your request. Approved refunds, if applicable, will be processed using the original payment method.

15. Disclaimer of Warranties

FunnelPool is provided on an "as available" and "as is" basis. While we strive to maintain reliable, secure, and high-performing Services, FunnelPool does not guarantee that the platform will always operate without interruption, delay, or error. To the fullest extent permitted by applicable law, FunnelPool disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

To the maximum extent permitted by law, FunnelPool, its affiliates, directors, employees, partners, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to your use of the Services.
This includes, but is not limited to:

  • Loss of profits.

  • Loss of business opportunities.

  • Loss of revenue.

  • Loss of data.

  • Business interruption.

  • Loss of goodwill.

  • Any damages resulting from third-party services or integrations.

Our total liability under these Terms shall not exceed the total subscription fees paid by you to FunnelPool during the twelve (12) months immediately preceding the event giving rise to the claim.

17. Limitation of Liability

You agree to defend, indemnify, and hold harmless FunnelPool, its affiliates, officers, employees, contractors, licensors, and partners from any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of:

  • Your use of the Services.

  • Your violation of these Terms.

  • Your infringement of any third-party rights.

  • Your violation of applicable laws or regulations.

18. Privacy

Your privacy is important to us. Our collection, use, storage, and protection of personal information are governed by our Privacy Policy, which forms part of these Terms. By using FunnelPool, you acknowledge that you have reviewed and accepted our Privacy Policy.

19. Force Majeure

FunnelPool shall not be liable for any delay or failure to perform its obligations resulting from events beyond its reasonable control, including but not limited to:

  • Natural disasters.

  • Internet outages.

  • Cyberattacks.

  • Government actions.

  • Labor disputes.

  • Utility failures.

  • Acts of war or terrorism.

  • Epidemics or pandemics.

Such events shall not constitute a breach of these Terms.

20. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our Services, legal requirements, or business operations. When material changes are made, we will update the Effective Date at the top of this page and may notify users through the platform or by email where appropriate. Your continued use of FunnelPool after such changes constitutes acceptance of the updated Terms.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which FunnelPool operates, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

23. Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and FunnelPool regarding your use of the Services. If any provision of these Terms is determined to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. Failure by FunnelPool to enforce any provision of these Terms shall not be considered a waiver of that provision or any other rights.

By accessing or using FunnelPool, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
